KNOW YOUR MIRANDA RIGHTS
The Constitution is an important tool for all of us. The Constitution gives all of us rights! It is important that we all become familiar with the rights the Constitution guarantees all of us.
Relevant to this posting, those suspected of crime must know their rights, including Miranda Rights.
In Miranda v Arizona, Ernesto Miranda, a defendant in the case was accused of kidnapping and raping a mildly retarded 18-year-old woman. He was found and brought in to the police station and questioned about the case. The officers told him that he did not have to talk if he did not want to and if he preferred to have an attorney present while he spoke and answered questions he could. The Supreme Court found that little advise by the officer was not sufficient and found that because Mr. Miranda was not advised of his rights prior to questioning that his confession would be suppress and kept out of evidence.
Miranda rights is named after that case. Because of this case, the police is now required to recite the following Miranda warning: "you have the right to remain silent. Anything you say can and will be used against you in a court of law. You have the right to an attorney. If you cannot afford one, one can be provided to you."
REMEMBER, just because you are arrested, that does not mean that you are entitled to be read Miranda rights and get the evidence thrown out of court if you weren't read the Miranda rights at that time. Miranda requires that you be questioned about pertinent things to the case prior to you having to be read your Miranda rights.
AGAIN KNOW YOUR RIGHTS. YOU WILL BE PRESUMED TO KNOW YOUR RIGHTS. YOU WILL NOT BE PERMITTED TO PLEAD IGNORANCE IN COURT. KNOW YOUR RIGHTS!!

Driving While License Suspended Penalties
Probably the most misconception there is out there is a believe that driving with a suspended license is merely a civil offense. That is not the case in Florida.
Depending on how your Driving While License Suspended offense is charged. It can be both a civil or a criminal offense.
A first offense of Driving While License Suspended is punishable up to 60 days in jail.
A second offense of Driving While License Suspended is punishable up to one year in jail.
A third offense or more of Driving While License Suspended is punishable up to five years in prison.
In addition to these punishment, if you have three driving while license suspended charge within a period of five years, your license will be suspended for five years.
As you can see, there are some pretty harsh penalties for driving with a suspended license. This is why, it is in your best interest to obtain an attorney prior to going to court and resolving this charge and any other criminal charges because a good attorney will know these rules and may be able to get around them so as to save you from some of these harsh punishments.

Importance of having an Attorney
Why is it important to have a good attorney represent you?
It is extremely important to have a very good attorney representing you if you are arrested for an offense of any kind. The importance of having a good attorney on your side is as important as having an expert doctor or an expert mechanic.
First, the reason why it is important to have a good attorney is because of the possible punishments that you face if you are convicted. If your case is a second degree misdemeanor you face up to sixty (60) days in jail; a first degree, you face up to one (1) year in jail; a third degree felony, you face up to five (5) years in prison; a second degree felony, you face up to fifteen (15) years in prison; and a first degree, you face up twenty-five (25) years in prison. In addition to these possible jail/prison sentences, if convicted you face having to pay court costs and fines.

Although the office is physically located in North Fort Myers, FL, I will take cases all over the twentieth judicial circuit, which include Lee, Collier, Hendry, Glades, and Charlotte county. If you are unable to travel to me, I will travel to you!
I am bi-language. I speak both English and Creole. If you need a Portuguese or Spanish Interpreter I have persons that can assist us with those languages.
